On January 23, 2020, the State Department and BIS jointly published rules revising USML Categories I (firearms, close assault weapons and combat shotguns), II (guns and armaments), and III (ammunition/ordnance) to transfer items that no longer warranted USML control under the ITAR to the CCL under the EAR. That transfer created a new set of ECCNs in the 0x5zz series: principally 0A501 (non-automatic and semi-automatic firearms ≤.50 cal), 0A502 (shotguns), 0A505 (ammunition), 0B501 (test/inspection equipment), and 0E505 (technology for 0A505 ammunition).
Implementation of the January 2020 rule was briefly interrupted by a March 6, 2020 preliminary injunction from a federal district court; the Ninth Circuit vacated that injunction, and BIS subsequently notified the public of the transfer's effectiveness. This August 2021 rule then cleans up ambiguities and errors that accumulated during that turbulent implementation period.
