This final rule creates 15 CFR § 743.6, a new "prior notification to Congress" section within Part 743 (Special Reporting and Notification) of the EAR. Before BIS may issue an export license for ECCN 0A501.a items (semiautomatic rifles and pistols) valued at $4 million or more to non-A:5/A:6 destinations, it must submit a prior notification to specified congressional committees (Senate Banking Committee, House Financial Services Committee, Senate Foreign Relations Committee, House Foreign Affairs Committee). The rule does not give Congress veto power; it is an oversight mechanism analogous to the State Department's Javits Act notifications for major ITAR arms sales.
The rule was adopted under ECRA authority (50 U.S.C. 4801–4852) and leverages the Biden administration's reclassification of most commercial firearms from ITAR (State Dept.) control to EAR (Commerce/BIS) control, which occurred via the 2020 Firearms Rule. By adding a congressional oversight tripwire for high-value semiautomatic exports, BIS responded to congressional concerns that the transfer from ITAR to EAR had weakened oversight by removing the traditional Javits Act notification path.
