EO 14324 invokes IEEPA to suspend the Section 321(a)(2)(C) "de minimis" administrative exemption — the mechanism that had let low-value parcels (≤$800) clear US customs duty-free with minimal paperwork, and that underpinned the direct-to-consumer parcel model used by Shein, Temu, and similar cross-border e-commerce platforms. The order globalized a suspension that the administration had already applied to China and Hong Kong-origin shipments earlier in 2025 (effective 2 May 2025), extending it to every country of origin. DHS/CBP's implementation notice built the customs-operational layer: covered articles must now use formal or informal ACE entry, pay the applicable Section 301/232/IEEPA and MFN duties for their HTS classification and country of origin, and declare origin even when shipped via post. The postal-network carve-out (a flat duty option rather than full formal entry) was itself closed by a June 2026 CBP rule that made the whole-mode suspension indefinite.
direct-to-consumer platforms undercut US retailers on landed cost; raises unit shipping/compliance cost per parcel across all origins, not just China.
(May 2025) and the broader IEEPA reciprocal-tariff regime (EO 14257/ 14326) to close nearly every low-value import channel that previously avoided tariff exposure.
operators and last-mile carriers (USPS, FedEx, UPS, DHL) handling low-value international parcels, and for marketplace platforms (Amazon Haul, eBay, Temu, Shein) that built fulfillment models around the exemption.
treats this as a permanent structural change to US low-value import policy rather than a temporary emergency measure, reducing the probability of reversal via sunset or emergency-redetermination.
entry fully replaces the postal flat-rate mechanism under the June 2026 rule.
or a similar challenge specifically targeting the de minimis suspension (as opposed to the reciprocal-tariff EOs) succeeds in narrowing or vacating this order.
