Presidential Determination under DPA §101 — recoverable critical minerals and materials (black mass, end-of-life REE magnets, swarf, scrap)

The President determined under section 101 of the Defense Production Act of 1950 that recoverable critical minerals and materials — black mass, end-of-life rare-earth permanent magnets, swarf, and waste/scrap containing critical minerals — are scarce and critical materials essential to the national defense, and that defense requirements cannot be met without significant civilian market disruption. The determination delegates DPA authority to the Secretary of Commerce to issue regulations, rules, guidance and procedures. Copper scrap is excluded, being covered by Proclamation 10962 (30 July 2025). The memorandum states no quantities.
