OFAC Sanctions Penalties Regulations (31 CFR Part 505) — consolidated IEEPA/UNPA civil-penalty procedures

Mechanism

Part 505 consolidates the IEEPA civil-penalty process (pre-penalty notice through final agency action, Subpart D) and UNPA penalty information (Subpart E), plus definitions and public-release provisions. Per the preamble, IEEPA civil monetary penalties run up to the greater of $377,700 or twice the transaction value; base penalties are halved where OFAC learns of the violation through voluntary self-disclosure. Criminal penalties under IEEPA/UNPA remain separate.

A companion rule (2026-20007, 91 FR 61727, effective 2026-09-30) removes the duplicative penalty text from roughly three dozen program parts (e.g. 510, 525, 560, 587, 589) and cross-references Part 505. It is cited here as secondary and not filed separately.

Downstream implications

• No change in substantive exposure; annual FCPIA inflation adjustments now apply in one place rather than per program.
• Compliance teams cite Part 505 rather than program-specific penalty sections.

Open questions

• Which further statutes (TWEA, Kingpin Act etc.) OFAC later folds into Part 505; the preamble leaves those in their current parts.
