Section 12(2) of the Precious Metals Act creates a licensing chokepoint on essentially all unwrought and semi-fabricated PGM exports from South Africa: no person may export such metals without the Minister of Mineral Resources' written approval, and that approval is statutorily conditioned on "the promotion of equitable access to, and the orderly local beneficiation of" the metals. Unlike a quota or tariff, the mechanism is a discretionary gatekeeping power — the Act itself sets no numeric threshold, fee, or quota, leaving the beneficiation condition to be applied case-by-case by the Minister/SADPMR. The Act commenced on 1 July 2007, roughly 15 months after assent, consistent with the standard practice of South African statutes requiring implementing regulations and regulator capacity (SADPMR) before proclamation.
This is a foundational, long-in-force instrument rather than a new measure — its significance for the register is coverage: South Africa is the dominant global supplier of platinum, rhodium and iridium (roughly 70-80% of mined output depending on metal), yet until this filing the register held no PGM-specific ZA export-control instrument, only generic mining-law and industrial-policy filings (MPRDA 2002, the 2025 Mineral Resources Development Bill, IDS 2026). IDS 2026's permit-conditioned beneficiation mandate for PGMs and other critical minerals builds directly on the same s.12(2) beneficiation-conditioning lever this Act already provides for platinum group metals specifically.
criteria, minimum local-beneficiation thresholds, or an export tax layered on top of s.12(2) approval, mirroring the 2025 chrome-ore ITAC permit regime) would be an amendment to this Act, not a new standing chokepoint — file such changes here via the amendments: schema.
chains face latent South African discretionary leverage independent of any new policy announcement, since the approval power has existed since 2007.
