Decreto 0977/2024 is the implementing regulation of Article 231 of the 2022-2026 Plan Nacional de Desarrollo (Ley 2294 de 2023), the statutory umbrella of the Petro administration's "Paz Total / Transición Energética Justa" programme. Technically the decree adds Chapter 12 to Title V, Part 2, Book 2 of Decreto 1073 de 2015 (the Único Reglamentario del Sector Administrativo de Minas y Energía), introducing the Distrito Minero Especial para la Diversificación Productiva as a new spatial-regulatory category alongside the existing concession, AME (Strategic Mining Reserve Area, governed by ANM Resolución 1006/2023) and ZIE/ZRE frameworks.
The decree identifies two sub-types:
artisanal-and-small-scale mining (ASM) presence and historical conflict overlay; the regulatory focus is formalisation of informal miners, transition to legal title under simplified procedures, and channeling ASM gold and other minerals through state-supervised value chains.
dominated by coal mining (principally Cesar, La Guajira) where the regulatory focus is productive reconversion away from thermal-coal extraction toward energy-transition activities. This is the spatial-policy expression of Petro's coal phase-out commitment.
Identification, prioritisation and delimitation of districts is led by MinMinas with UPME technical support; ANM holds operational authority over concession-level decisions inside delimited districts. The first two pilot districts were announced 12 September 2024 (per Infobae reporting).
