ECRA Section 1758 (2018) requires the US Government to identify and control emerging and foundational technologies essential to national security that are not yet covered by the multilateral export-control regimes (Wassenaar Arrangement, NSG, MTCR, Australia Group). BIS implements these controls by adding items to the 0Y521 temporary ECCN series (0A521–0E521) under Supplement 4 to Part 774 of the EAR. Controls are imposed as interim final rules, effective immediately, and must be renewed annually under ECRA § 1758(c) until:
1. A multilateral regime adopts equivalent controls (the 0Y521 classification is retired and replaced with a permanent ECCN); or 2. BIS determines the technology no longer warrants control and allows it to lapse.
The 0Y521 series is controlled for NS, RS, AT, and UN reasons; only License Exception GOV is typically available, making commercial exports to Country Group D (China, Russia, Iran, and others) effectively prohibited without a specific licence.
