US nuclear nonproliferation export controls on China and Macau sit at the intersection of two regulatory frameworks:
1. BIS Export Administration Regulations (EAR) — 15 CFR Parts 738 and 742 govern dual-use items with nuclear application. NP2 (Nuclear Nonproliferation column 2) controls apply to items that could support nuclear weapons programs outside the NPT safeguards regime. 2. NRC Regulations — 10 CFR Part 110 governs exports of nuclear materials and reactors.
Prior to August 2023, China and Macau were not subject to NP2 controls in the EAR, despite being subject to NP1 controls for items more directly tied to nuclear weapons. The August 2023 rulemaking closed this gap.
